These Terms and Conditions ("Terms") form a binding agreement between you ("Parent", "Guardian", "you") and Renaldo Hickman t/a StudyMyWay ("StudyMyWay", "we", "us"), a sole proprietorship operating through https://studymyway.co.za.

By ticking the required acceptance boxes and completing registration, you confirm that you have read, understood and agree to these Terms, the Privacy Policy, the Acceptable Use & Content Policy and the Copyright/Takedown Policy.
If you do not agree, you may not register for or use the Service.
StudyMyWay allows Parents to upload educational material, process it using OCR and/or AI-assisted services, generate quizzes and mind maps, review generated material, allow Students to complete quizzes and view learning/progress information.
We may add, modify, suspend or discontinue features. We will not intentionally remove the core value of an active paid Subscription without reasonable notice, subject always to maintenance, security, legal and operational requirements.
Unless a different price is clearly displayed before payment, the current intended pricing is:
Payment will be processed through the selected payment provider (intended provider: PayFast). StudyMyWay does not intend to store full card details. Payment credentials and payment processing are handled by the payment provider subject to its own terms and security controls.
The monthly Subscription renews automatically until cancelled, subject to the payment authorisation presented and accepted during registration.
We may change pricing on notice, subject to applicable consumer law. Any material price increase will be communicated before it takes effect.
Nothing in these Terms limits a consumer right that cannot lawfully be excluded or limited under the Consumer Protection Act or other applicable law.
You retain ownership of Content you upload, subject to the licences expressly granted in these Terms.
You warrant that you own, or have all rights, permissions and lawful authority necessary to upload, store, reproduce, process, transform and use the Content for the purposes for which you submit it.
This includes rights required for scanning, OCR, extraction, AI processing, storage, generation of derivative educational outputs and, where applicable, community sharing.
You must not upload material merely because you lawfully purchased or possess a copy if you do not also have the rights required for the particular use. For example, possession of a textbook does not by itself establish a right to reproduce or distribute the entire textbook through StudyMyWay.
You must not upload unlawful, obscene, sexually explicit, exploitative, abusive, hateful, threatening, malicious or otherwise prohibited material, or personal information of third parties without a lawful basis and required consent.
You grant StudyMyWay a limited, non-exclusive, worldwide, royalty-free licence for the duration reasonably necessary to provide the Service to you, including to host, store, reproduce, transmit, OCR, extract, transform and submit relevant Content to authorised service providers used to operate AI, storage, security, email and related functionality.
This licence does not transfer ownership of your Content to StudyMyWay and does not give StudyMyWay a general right to sell your Content.
If you deliberately choose to share Content with the StudyMyWay community, you grant StudyMyWay the additional rights necessary to store, display, reproduce and distribute that Shared Content to other authorised users for community educational functionality.
You warrant that you have the legal right to make Shared Content available to other users, not merely to StudyMyWay.
You must remove or redact unnecessary personal information, including names, photographs, school details, contact details, identifiable handwriting and other information about yourself, your child or third parties.
Other users may be permitted to copy/Fork, adapt and use Shared Content for their own Students. Once a Fork has been created, withdrawing the original share may not automatically delete independent copies already created.
We may review, moderate, refuse, restrict or remove Shared Content. We are not obliged to proactively review every item before publication.
StudyMyWay and its licensors retain rights in the Service, software, branding, interface, workflows and underlying technology. You may not copy, resell, sublicense, reverse-engineer or commercially exploit the Service except as expressly permitted.
Your Content remains yours, subject to the licences necessary to operate the Service and any licences arising from your decision to share Content.
StudyMyWay processes personal information in accordance with POPIA and the StudyMyWay Privacy Policy. The Privacy Policy forms part of these Terms.
StudyMyWay may process Parent and Student information, uploaded learning material, quiz answers, results and related technical/account information to provide the Service, administer accounts, process payments, communicate with users, maintain security, provide AI functionality, comply with law and perform other disclosed purposes.
StudyMyWay may use essential authentication, security, session and functionality cookies or similar technologies. Additional analytics or marketing technologies will only be used as described in the Privacy Policy and, where required, with appropriate consent.
Your use of StudyMyWay is subject to the Acceptable Use & Content Policy, which forms part of these Terms. Prohibited material may be removed and an Account may be suspended or terminated.
StudyMyWay respects third-party intellectual property rights. The Copyright/Takedown Policy sets out the process for reporting alleged infringement and responding to notices. A valid complaint may result in temporary restriction or removal while the matter is assessed.
The Service is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee uninterrupted, error-free or completely secure operation, nor the accuracy of AI outputs, Shared Content or academic outcomes.
Nothing in these Terms excludes a consumer right, warranty or remedy that cannot lawfully be excluded.
To the maximum extent permitted by law, StudyMyWay's aggregate liability arising from the Service will be limited to the Subscription fees actually paid by the affected Parent during the three months preceding the event giving rise to the claim, excluding liabilities that cannot lawfully be limited.
We will not be liable for indirect or consequential loss, loss of study time, academic outcomes or loss caused by Content supplied by a Parent or another user, except to the extent liability cannot lawfully be excluded.
To the maximum extent permitted by law, you agree to indemnify and hold StudyMyWay harmless against third-party claims, losses, costs and reasonable expenses arising from your breach of these Terms, your misuse of the Service, or Content you upload or share, including claims alleging copyright, trade mark, confidentiality, privacy, defamation, unlawful-content or other rights infringement caused by your Content or your instructions.
This indemnity does not apply to the extent a claim is caused by StudyMyWay's own unlawful conduct, fraud, wilful misconduct or liability that cannot lawfully be transferred.
We maintain reasonable technical and organisational measures appropriate to the nature of the information processed. If a security compromise occurs that triggers a notification obligation under applicable law, we will follow the applicable legal notification and response requirements.
On termination, access ends subject to applicable retention requirements. Personal information and Content will be deleted, returned or retained in accordance with the Privacy Policy, legal obligations, backup cycles, dispute resolution needs and legitimate security requirements.
We may update these Terms to reflect service, legal or operational changes. Material changes will be communicated through the Service or by email where appropriate. The effective date will be shown at the beginning of the document.
These Terms are governed by South African law. Disputes are subject to the jurisdiction of South African courts, without limiting statutory consumer rights or rights to approach the applicable regulator, ombud or other competent body.
Complaints should first be directed to support@studymyway.co.za. POPIA complaints may also be directed to the Information Regulator where appropriate. Copyright complaints should follow the Copyright/Takedown Policy.
