StudyMyWay.co.za – Privacy Policy

This Privacy Policy explains how StudyMyWay collects, uses, stores, shares, protects and deletes personal information when Parents and Students use the StudyMyWay platform.

It operates together with the Terms and Conditions, Acceptable Use & Content Policy, Copyright/Takedown Policy and PAIA Manual.

StudyMyWay intends to process personal information in accordance with POPIA, including its requirements relating to lawful processing, purpose specification, further processing, information quality, openness, security safeguards, data-subject participation and children's personal information.

Parents should provide only the minimum Student information reasonably required by the Service. StudyMyWay does not intend to collect unnecessary information about children.

Parents may upload PDFs, scanned documents, worksheets, images, notes and other educational material. Such files may contain personal information. Parents remain responsible for ensuring they have the rights and lawful basis required to upload the material.

StudyMyWay may use essential cookies or similar technologies to authenticate users, maintain sessions, protect the application, remember necessary settings and operate the Service.

These may include ASP.NET Core/Identity authentication and security mechanisms. Such technologies are necessary for core functionality and are not intended to be used as advertising trackers.

If StudyMyWay later introduces analytics, advertising, social-media pixels or other non-essential tracking, the relevant technology, purpose and consent mechanism will be disclosed before or when it is introduced, where required.

The appropriate lawful justification may differ depending on the processing activity and must be documented by StudyMyWay. Depending on the circumstances, processing may rely on consent, performance of a contract, compliance with a legal obligation, legitimate interests where lawful, or another POPIA-recognised basis.

Where consent is relied upon, relevant consent will be requested clearly and may be withdrawn subject to lawful consequences and records that StudyMyWay is required to retain.

Student profiles are intended to be created by Parents or lawful guardians, not by children themselves. StudyMyWay treats children's personal information as requiring enhanced care.

The Parent represents that they have the necessary authority to consent to processing of the Student's information for the Service. StudyMyWay will not knowingly use Student information for direct marketing aimed at children.

StudyMyWay should collect only information reasonably necessary for educational functionality and should avoid unnecessary identifiers, photographs, school details and sensitive information.

StudyMyWay uses AI services to process relevant educational material and generate quizzes, mind maps, summaries, feedback and related outputs.

Depending on the feature, relevant extracts or text may be transmitted to an authorised AI provider such as OpenAI. StudyMyWay should configure the provider and contractual relationship appropriately and should not send information that is unnecessary for the requested feature.

StudyMyWay may use third-party providers to operate the Service. Current intended provider categories include:

StudyMyWay will seek appropriate contractual and security arrangements with operators/service providers and will disclose material processing relationships where required.

Some service providers may process or store information outside South Africa. StudyMyWay will assess applicable POPIA requirements for cross-border transfers and implement an appropriate lawful basis and safeguards before or when such transfers occur.

Private Content is used to provide the Service to the Parent and their Student(s). If a Parent chooses to make a chapter or other material available to the StudyMyWay community, the Parent instructs StudyMyWay to make that Shared Content available to authorised users in accordance with the Terms.

Parents must not share unnecessary personal information about children or third parties. Shared Content may be copied/Forked by other users and therefore may remain in independent user accounts after the original Parent stops sharing it.

StudyMyWay intends to use PayFast for payment processing and does not intend to store full payment-card details on StudyMyWay's own systems. Payment providers process payment information under their own privacy/security terms. StudyMyWay may retain transaction references, subscription status, amounts, dates and other accounting information required to operate the subscription and comply with law.

StudyMyWay intends to use Resend for transactional and service emails. These may include registration confirmations, password/account messages, payment notifications, security notices and other service communications.

Any direct marketing by electronic communication will be conducted subject to applicable law, including requirements concerning consent, opt-out mechanisms and existing customer relationships where applicable.

No internet service can guarantee absolute security. StudyMyWay will respond to suspected compromises in accordance with applicable law and its incident-response procedures.

StudyMyWay will retain information only for as long as reasonably necessary for the purpose for which it was collected, to provide the Service, maintain records, resolve disputes, enforce agreements, prevent fraud, maintain backups and comply with legal/accounting obligations.

Requests should be submitted to Support@studymyway.co.za. StudyMyWay may need to verify identity before releasing, correcting or deleting information.

Requests for access to records are handled in accordance with PAIA and StudyMyWay's PAIA Manual. The PAIA Manual describes categories of records and the procedure for making requests.

Please first contact Support@studymyway.co.za. If unresolved, a data subject may approach the Information Regulator through its official channels.

This Privacy Policy may be updated when the Service, providers, processing practices or legal requirements change. The latest version will be published at https://studymyway.co.za.
