StudyMyWay.co.za – Copyright & Takedown Policy

Copyright complaints, infringement notices and content removal process

StudyMyWay respects copyright and other intellectual property rights. StudyMyWay does not claim ownership of Parent-uploaded Content merely because it is uploaded.

A Parent who uploads Content warrants that they own the Content or have the rights and permissions necessary for the intended use. A Parent who shares Content additionally warrants that they have the right to make it available to other StudyMyWay users.

Parents remain responsible for the legal consequences of Content they upload or share.

Send complaints to Support@studymyway.co.za. The complaint should contain enough information to identify the claimant, protected work and allegedly infringing Content.

  1. Your full name and contact details.
  2. If acting for an organisation/rightsholder, the organisation name and authority to act.
  3. Identification of the copyrighted work or other right allegedly infringed.
  4. A description sufficient to identify the StudyMyWay Content, including chapter/title, uploader information if visible, URL or other location and screenshots where helpful.
  5. An explanation of why the use is allegedly unauthorised.
  6. Any relevant registration, licence or ownership information.
  7. A good-faith statement that the use is not authorised by the rights owner, agent or law.
  8. A statement that the information is accurate and that you are authorised to complain.
  9. Electronic or physical signature.

StudyMyWay may acknowledge the complaint, restrict access while investigating, request further information, contact the uploader or take other reasonable action.

A complaint does not automatically establish infringement. StudyMyWay may consider the uploader’s evidence, licence/permission, nature of use and applicable law.

Where there is a credible claim and continued availability creates significant legal risk, StudyMyWay may temporarily disable access pending further information.

The uploader may respond by providing evidence that they own the rights, have permission, have a valid licence or otherwise have a lawful basis. Send responses to Support@studymyway.co.za.

StudyMyWay may restore Content where the evidence reasonably supports restoration, but is not required to act as a court or determine complex ownership disputes.

Where disputed material has been Forked, StudyMyWay may restrict the original and/or affected copies where technically and legally appropriate. Removal of the original may not automatically remove every previously Forked copy.

StudyMyWay may suspend or terminate accounts associated with repeated or serious infringement, subject to applicable law and the Terms.

A person must not knowingly submit false, misleading or abusive infringement notices. StudyMyWay may take appropriate action against misuse of the takedown process.

StudyMyWay may preserve or disclose information where required by law, a valid court order, competent authority or applicable legal process.

Where applicable, StudyMyWay will operate its notice-and-takedown procedures consistently with South African law, including applicable provisions of the Electronic Communications and Transactions Act 25 of 2002. The exact procedure should be confirmed by the legal adviser before publication.
